Privacy Policy (updated November 13, 2014)

Smule, Inc. (“Smule” or “we”) shares the concerns of users of our applications and websites (“you”) about the protection of your personal information. This is our policy regarding the privacy of information we collect inside our applications and websites. This privacy policy applies to the website and all of the internet-accessible web properties and applications owned or operated by Smule. This policy does not apply to the practices of companies that we do not own or control. This policy includes examples of the types of information we collect, and the kinds of parties with whom we share such information. These examples are illustrative and should not be considered a complete inventory of our information collection, use, and sharing practices.

By installing, using, or accessing our applications or websites, you agree to this policy. If you do not agree to this policy, do not install, use, or access our applications or websites. We may update this policy from time to time and will post updates to this policy on this web page, including the policy’s effective date.

Information Smule gathers and how Smule uses it

We collect certain information from you in order to provide you with the most interesting and useful applications and websites possible.

iOS or Android platforms

When you use our applications, we collect your unique device ID, hardware type, the version of your operating system, your activity within our application, and your location (based on opt-in location-based services, which rely upon a device’s GPS coordinates).

Platforms/third-party marketplaces

Third-party libraries included in our applications will collect device information and user activity within the application. Third-party platforms and marketplaces through which our applications are made available may collect information about you or receive information from us in order to provide or analyze their services. These third-party platforms and marketplaces are neither developed nor administered by us and we are not responsible for the actions of those third-parties. You should carefully review the terms of service and privacy policies of such third-parties that you use to access our applications.

Third party social networks

If you sign into our applications or the Smule website with a third party social network, such as Facebook Connect, we will collect any information that you have agreed to make available to it through such account, which may include: (1) your first and last name, (2) your user ID, (3) your profile picture/URL, (4) your list of friends, (5) your email address and/or (6) your birthday. This information will be primarily used for user registration and to enhance your social experience, which may include friend-to-friend interaction and notifications, chat, or messaging functionality, public leaderboards, head-to-head competition and other similar features. If you sign into Smule with a third party social network and agree to make your list of friends on such network available to Smule, your friends on such network will automatically follow you on our websites and applications and your Smule account will be automatically configured to follow your friends. You can, however, unfollow any other user on Smule at any time.

Google Analytics

We use Google Analytics’ Demographics and Interest Reporting feature to collect information about use of the website. Google Analytics collects information such as how often users visit this site, what pages they visit when they do so, and what other sites they used prior to coming to this site. We will not facilitate the merging of personally-identifiable information with non-personally identifiable information collected through Google Analytics unless we have robust notice of, and your prior consent to, that merger. You may opt-out of Google Analytics tracking with the Google Analytics opt-out browser add-on.

In-game dialog boxes

When you register in our applications, we may ask whether you’d like to provide us with certain pieces of information, which could include your email and username. We will do this through in- game dialog boxes.

We use user information and/or unique device IDs to understand usage of our applications and troubleshoot and improve our applications.

We use contact information to update you on Smule products, provide customer support, and connect you to other users of our applications.

We use your IP address to identify you, to gather demographic information that helps us understand how you and our other customers use our website and applications, and to administer our websites.

We sometimes conduct or sponsor surveys and contests. If you elect to participate, we may ask you for contact, demographic, and other information as part of these offerings. We use this information to analyze and report on the results of surveys, to improve our applications, and to provide you with the results of the surveys and contests. Participation in surveys and contests is completely voluntary.

Information Smule may disclose

We do not sell or disclose personal information about you to other people or nonaffiliated companies except to provide you with products or services, when we have your permission, or under the certain circumstances detailed in this privacy policy.

We share demographic, profile and other general information about you and our other customers with our partners on an aggregate basis. This means that we tell our advertisers general information about the characteristics of our customer base, but we do not specifically identify a particular user or visitor or provide the user’s contact information to our advertisers. We may share your unique device ID with advertisers or your location (based on opt-in location-based services, which rely upon a device’s GPS coordinates).

Disclosures permitted by law

  • We provide information on a confidential basis to nonaffiliated companies we engage as contractors or agents to perform services for us, such as maintaining software, sending direct mail, or administering a contest. Information will be shared with such contractors only to the extent reasonably necessary for them to perform services on our behalf, and pursuant to confidentiality obligations;
  • We may provide information in response to subpoenas, court orders, or legal process, from law enforcement agencies or state and federal regulators;
  • If Smule is acquired by or merged with another company, we will notify you before information about you is transferred and becomes subject to a different privacy policy.
